REFUNDS FOR DIGITAL PRODUCTS OR SUBSCRIPTIONS

No Refunds. Except as described below, all Fees assessed by Nifti are non-refundable, and Nifti does not provide Fee refunds or credits for partially used or unused subscriptions. If you sign up for a Service subscription but do not access the Service or Platform, you are still responsible for all Fees during the term of your subscription. If Nifti chooses at its sole discretion to issue a refund or credit in one instance, we are under no obligation to issue the same refund or credit in the future.


We reserve the right to issue refunds or credits at our sole discretion in the following situations:

1 . Where we materially modify these Terms of Service or Privacy Notice during a billing period and such modification adversely affects you, we may refund a portion of your subscription Fee equal to the remaining unused term, as we determine appropriate or as may be required by applicable law. To be eligible for a refund, you must provide written notice that (a) identifies your account and (b) requests cancellation of the specific Service. The cancellation will be effective upon our receipt of your notice and our determination that you are authorized to effect such cancellation. Please refer to the “Communications and Contact Information” section located in our Terms and Conditions on how to provide notice to us.

2 . Where a modification or interruption of Services adversely affects you and alternative remedies, as specified in our Terms and Conditions, are not available, we may refund a portion of your paid subscription Fee equal to the remaining unused term of your subscription, as we determine appropriate or as may be required by applicable law.

When you cancel a subscription with us, you will continue to receive your subscription benefits until the end of the current billing period. You will not receive a refund of any portion of the subscription fees you paid for the current or prior billing periods.

Example: If your monthly subscription is for the period March 1st through March 31st and we process cancellation of a monthly subscription on March 7th, you will continue to receive the benefits of that subscription until March 31st and there will not be a refund of any part of the March monthly subscription fee. You will neither be billed for nor receive the benefits of the cancelled subscription after March 31st.

Do not wait until the end of a billing or subscription period to make a subscription cancellation request because such requests are typically processed within 2 to 3 business days after we receive them. As it takes longer for us to receive postal mail than electronic mail, we recommend that you email your request. Providing us with your account/subscription number (if you have one) can also speed up the process of honoring your request.

We will confirm your subscription has been cancelled by either email or postal mail.

SUBSCRIPTION TERMS AND AUTOMATIC PAYMENT 

A Nifti user is responsible for paying all sums due to Nifti in connection with their monthly subscription in accordance with these Terms. The first fee payable in accordance with these Terms is due when the user account is set up and payment of the monthly fee is a condition of access, or after your free trial ends and you have not canceled the automatic subscription with us. Every calendar month, your account will be charged the subscription fee plus any applicable tax for the following month’s subscription, together with any other fees for the following month’s subscription plus any accumulated charges for the past period (collectively, “Fees”). Failure by the Nifti user to use any of the services available through the service provided by Nifti does not relieve the Nifti user of their payment obligations under these Terms.

IF YOU ARE A Nifti USER WITH A MONTHLY SUBSCRIPTION AND YOU HAVE PROVIDED US WITH A VALID CREDIT OR DEBIT CARD NUMBER OR AN ALTERNATE PAYMENT METHOD, EACH PAYMENT WILL BE AUTOMATICALLY PROCESSED AT THE TIME OF YOUR DESIGNATED PAYMENT DATE (MONTHLY) AND WILL BE BILLED TO THE PAYMENT METHOD YOU PROVIDED TO US AT THE TIME OF YOUR ENROLLMENT. IF YOU WISH TO CANCEL YOUR SUBSCRIPTION TO Nifti, YOU MAY DO SO BY EMAILING INFO@NIFTIDIGITAL.COM AT LEAST TEN (10) DAYS BEFORE THE FIRST DAY OF YOUR NEXT SUBSCRIPTION MONTH.

Nifti reserves the right to immediately terminate a user’s account and/or service for any unpaid (in whole or part) period of the subscription (with or without notice). Termination of service in no way relieves or excuses the user from any obligation to pay outstanding charges or expenses. In the event Nifti starts collection processes of any type, you will be liable for all collection costs, including legal fees and expenses.
